Understanding Insurance Contracts in ConnecticutInsurer

In the world of personal injury and property damage claims, the insurance company providing coverage is commonly referred to as the “insurer.” This term encompasses not only the insurance company itself but also individuals who work for or on behalf of the insurer, such as insurance adjusters and claims representatives. However, it does not include the attorney representing the insurance company.

The Parties Involved in an Insurance Contract

An insurance contract typically involves two primary parties: the insured and the insurer. However, a third party—the third-party beneficiary—also plays a crucial role in the insurance landscape.

The Insured

The insured is usually the individual or entity that pays the insurance premiums. This may include the insured’s immediate family members and anyone authorized to use their property, such as a friend who is allowed to drive their car. For non-auto insurance contracts, it is essential to review the specific policy language to determine who qualifies as an insured individual.

The Insurer

The insurer is the insurance carrier, the entity responsible for drafting the insurance contract, collecting premiums, and disbursing benefits when necessary. The insurer’s obligations are confined to the terms laid out in the policy, which specifies the coverage provided and the conditions under which claims will be paid.

The Third-Party Beneficiary

The third-party beneficiary is often the individual who has suffered damages or losses due to the actions of the insured. Although this person is not part of the insurance contract, they are the reason the contract exists in the first place, as they are the ones who receive compensation for their losses.

The Mechanics of Insurance Contracts

Insurance contracts involve a payment of premiums, typically on a monthly basis, in exchange for protection against specified losses. These losses are explicitly defined within the insurance policy, ensuring that the insurer only pays benefits when the injuries or damages meet specific criteria outlined in the contract.

Claims and Payments

When it comes to claims, one of the most important questions is: Who does the insurer pay? Generally, the insurer will compensate the individual who suffered the losses—the third-party beneficiary. The nature of the losses and the type of insurance will determine the identity of the third party. Here are a few examples:

  • If an individual suffers a dog bite, the homeowner’s insurance policy may cover the victim’s losses resulting from the incident.
  • In the event of a car accident, the auto insurance policy may pay for the injuries and property damage sustained by the other driver.
  • If someone slips and falls on another person’s property, that individual’s property insurance (whether it’s homeowners’ insurance or an umbrella policy) is likely to address any injuries resulting from the fall.

There are instances where the insurer pays the insured directly, especially when the insured has suffered losses themselves. For example, if a severe storm causes damage to a home, the homeowner’s policy will typically cover the repair costs.

Many first-party insurance coverages, including uninsured motorist coverage, are designed to address medical expenses and property damage resulting from accidents involving uninsured drivers.
