However, during court proceedings, the driver attempts to present conflicting defenses.
Against the individual in the other vehicle, the driver claims that he was sober and that the other driver was at fault. Conversely, when addressing his passenger, he admits to being intoxicated, arguing that the passenger was aware of his condition and shares some blame for the injuries incurred.
These contradictory defenses cannot coexist; the driver cannot be both sober and drunk simultaneously. The doctrine of estoppel will come into play, requiring him to choose one narrative or accept the version presented by the court. This example underscores how estoppel promotes consistency and fairness in legal proceedings.
Enforcement of Estoppel
The enforcement of estoppel primarily falls to the courts. Typically, one party will highlight the inconsistency in the opposing party’s claims, requesting the court to deem that party “estopped” from presenting certain arguments. If the court agrees, those claims will be disallowed in that case.
Referring back to our drunk driving example, the injured party from the other vehicle could point out that the driver previously acknowledged his intoxication in another court case. Consequently, the court may reject the driver’s claim of sobriety, compelling him to defend against the charges based on other arguments.
