Employers are expected to provide proper training and supervision, and as such, are held accountable for the actions of their staff. This structure ensures that victims can pursue compensation from a responsible party—typically an employer who possesses liability insurance and financial resources to address claims.

Types of Cases Covered by Vicarious Liability

Vicarious liability is most commonly associated with premises liability cases, where injuries occur on a business’s property. However, its applicability extends to various other scenarios, such as automobile accidents involving delivery drivers or other employees acting in the course of their employment. Understanding the nuances of each case is crucial, as vicarious liability can vary based on numerous factors, including the nature of the employment relationship and the specifics of the incident.

Employees vs. Independent Contractors

One significant distinction in vicarious liability cases in Connecticut is the difference between employees and independent contractors. Generally, employees are covered under vicarious liability, meaning employers are responsible for their actions during work. However, independent contractors, often referred to as “1099 workers,” may not always be protected under this doctrine. In many cases, contractors are personally liable for their actions, even if those actions arise during their work.

In Connecticut, the employer may still be held liable for an independent contractor’s actions if:

  • The contractor’s actions were required by a contract or by law.
  • The work being done is inherently dangerous or wrongful.
  • The employer directed the contractor to perform the specific action.
  • The employer ratified or approved the contractor’s actions.

Exceptions to Vicarious Liability

While vicarious liability provides broad protection, there are exceptions. For instance, an employer is only liable if the employee’s actions occurred within the scope of their employment. For example, if a delivery driver hits a pedestrian while making deliveries, the employer may be held responsible. Conversely, if an office worker causes an accident during their commute, their employer is not liable, as the commute is not part of their job responsibilities.

Additionally, extreme cases where an employee acts outside the scope of their duties—such as taking a company vehicle for personal joyriding—may result in that employee being held personally liable. However, employers may still share some liability if they failed to adequately train or supervise their employees.
